Terms of Service

These Terms of Service ("Terms") govern your use of Baseball GM ("the app"). By downloading or using the app, you agree to these Terms. If you don't agree, please don't use the app.

The App

Baseball GM is a single-player baseball simulation game published by David Sonnenberg ("we," "us"). The app is licensed to you, not sold. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use.

Fictional Content

All franchises, players, staff, cities as depicted in the game, and other content in the app are fictional. Baseball GM is not affiliated with, endorsed by, or licensed by Major League Baseball, the Major League Baseball Players Association, or any other real-world professional baseball league, team, or organization. Any similarity between fictional entities in the game and real-world persons or organizations is coincidental.

What You Can't Do

You agree not to:

Reverse-engineer, decompile, or disassemble the app, except where permitted by applicable law.
Modify, adapt, or create derivative works based on the app.
Redistribute, sell, rent, lease, or sublicense the app.
Remove or alter any copyright, trademark, or other proprietary notices.
Use the app in any way that violates applicable laws.

Updates

We may release updates to the app from time to time to add features, fix bugs, or improve performance. Updates are delivered through the App Store. We may add, remove, or change features between versions. We are not obligated to provide updates or continued support indefinitely.

Save Data

Your game saves are stored locally on your device. We do not back them up. If you uninstall the app, reset your device, or your device is lost or damaged, your saves may be lost. We are not responsible for lost save data.

Purchases and Refunds

Baseball GM is a one-time purchase through the App Store. All purchases are handled by Apple, and Apple's refund policies apply. Refund requests should be directed to Apple through your App Store account. We do not process refunds directly.

Feedback

If you send us feedback, suggestions, bug reports, or ideas about the app, you agree that we may use them freely, without any obligation of compensation or attribution to you, and that any such feedback is non-confidential. We won't share your identity or contact information without your permission, but we may act on ideas you send us.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF BUGS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF SAVE PROGRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.

Termination

We may terminate or suspend your license to the app if you violate these Terms. You may stop using the app at any time by uninstalling it. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute-resolution provisions) will do so.

Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the app will be resolved in the state or federal courts located in Cook County, Illinois.

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted at this URL with a new "Last updated" date. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.
